Welcome to Haven DesignScapes (“we,” “us,” “our”). These Terms & Conditions (“Terms”) govern your access to and use of our website, communications, and related services provided by Haven DesignScapes LLC, a U.S. landscape-design and outdoor-living company.

By accessing or using our website or services, including opting in to receive SMS/text messages, you agree to these Terms. If you do not agree, please discontinue use immediately.

Our Services

• Scope of Work. Haven DesignScapes provides residential and commercial landscape design, 2D and 3D rendering, outdoor-living planning, construction consulting, and related services (“Services”).

• Service Areas. We currently serve clients in North Carolina and Long Island, New York, and nearby communities.

• Design Visualizations. Renderings and virtual tours are conceptual; actual project results may differ based on materials, site conditions, and regulatory factors.

• Project Agreements. Each project is governed by its own written proposal or contract. If there is any conflict, that specific agreement overrides these general Terms.

Website Use & Accounts

Eligibility. You must be at least 18 years old and legally capable of entering into a binding contract.

Account Responsibility. If you create an account, you are responsible for maintaining its confidentiality and for all activity under it.

Permitted Use. You may use our website only for lawful purposes.

Prohibited Actions. You agree not to:

• Upload or transmit malware, spam, or harmful code;

• Attempt to gain unauthorized access to restricted areas;

• Copy or distribute our proprietary content without permission;

• Use automated tools to extract data (“scraping”).

Payments & Fees

• Pricing. All prices are in U.S. dollars (USD).

• Payment Terms. Payments are due according to your project agreement (for example, deposit, milestone, or completion).

• Late Payments. Late balances may incur interest at 1.5% per month or the maximum allowed by law.

• Refunds & Cancellations. Refunds are handled per your signed contract. Completed design or consulting work is non-refundable.

• Change Orders. Client-requested scope changes require a written change order and may affect cost or completion date.

Project Delivery & Liability

• Estimated Timelines. Project schedules are estimates only. We are not liable for delays caused by weather, supply issues, permitting, or events beyond our control.

• Site Access. Clients must provide safe access to the property and any required permits or approvals.

• Warranty. Workmanship and materials are warranted for one (1) year from completion, unless otherwise stated.

• Limitation of Liability. To the fullest extent permitted by law, our total liability for any claim shall not exceed the total amount paid for the specific project. We are not liable for indirect or consequential damages.

A2P Messaging & Text Communications (TCPA Compliant)

We use SMS and MMS messaging to communicate with clients for updates, reminders, or promotions.

• Opt-In Consent. By providing your mobile number and opting in, you consent to receive text messages from Haven DesignScapes. Message and data rates may apply.

• Opt-Out. Reply STOP to any message to unsubscribe. We will confirm your request and cease messaging.

• Help. Reply HELP or contact hello@havendesignscapes.com

• Message Frequency. You may receive up to 10 messages per month, unless additional messages are required for active project communications.

• Privacy. We do not sell or share your number for third-party marketing. Data may be shared only with trusted service providers for operational purposes.

• Carrier Liability. Mobile carriers are not responsible for delayed or undelivered messages.

• Compliance. Messaging practices comply with the Telephone Consumer Protection Act (TCPA), CAN-SPAM Act, and carrier A2P 10DLC requirements.

Intellectual Property

All text, graphics, renderings, and other website content are the exclusive property of Haven DesignScapes LLC or its licensors. You may not reproduce or use them without prior written consent.

Privacy Policy

Our Privacy Policy explains how we collect, use, and protect personal information. It is incorporated into these Terms by reference and available at havendesignscapes.com/privacy.

Third-Party Links & Services

Our website may link to third-party sites or tools (such as payment processors or SMS gateways). We are not responsible for their content or practices.

Dispute Resolution & Governing Law

• Governing Law. These Terms are governed by the laws of the State of North Carolina, without regard to conflict-of-law principles.

• Dispute Resolution. Any dispute shall first be addressed through good-faith negotiation. If unresolved, it will be submitted to binding arbitration in Wake County, North Carolina, in accordance with the rules of the American Arbitration Association (AAA).

• Attorneys’ Fees. The prevailing party in arbitration or litigation may recover reasonable attorneys’ fees and costs.

Modifications & Updates

We may update these Terms at any time. The “Last Updated” date above reflects the latest version. Continued use of our website or services after changes constitutes acceptance of the revised Terms.
